When an adult is smoking in a car with little kids in the backseat and the kids are subjected to secondhand smoke, who protects their rights?

The whole point of any government is to restrict individual freedom in favor of the greater good. No one has a problem when government restricts people from killing and stealing. That, however, infringes on the individual freedom of people who like to steal and kill. What makes it a free country is the ability to criticize the government when you don't think they made the right choice. If you had a business in China, you wouldn't be able to post this without fear of reprisal. You also have freedom in that you can, if you so desire, work to change the government policy. You have access to political power through your right to vote and your right to free speech. I think your issue is not with your "freedom" but what you believe constitutes the greater good. Is it more important that people be able to smoke or is it more important that people who do not smoke are protected from the harmful affects of smoke? Is it more important that people get to eat tasty food or is it more important that stupid birds are saved from being force feed? I believe both regulations have considerable merit. But I'm also a smoker and a fois gras consumer. Now the real question is whether the birds are adequately protected from second hand smoke . . . .

Nobody can control your home or car.

The problem is people smoke in other people's cars and homes and offices. Some people are allergic and others eventually die of cancer.

If you don't care about the heath of your family, the law won't protect them.

My father was case in point. Mostly a nice person but he considered people not allowing him to smoke in their homes and endanger their health the "selfish" me generation. He even blew smoke in my face without thinking about it.

The only thing that pisses me off are smokers who turn around and sue the tobacco companies when they die of cancer.

P.S My dad was a very nice guy, but he looked like a skeleton when he died. If that's how you want your family to remember you, please smoke away. Again, tho, don't blame anybody but yourself for your untimely demise.

Excuse me while I go buy more Philip Morris stock so I can cash in legally on your addiction.

No.I mean my home or my car are mine and I don't smoke so I do not want you to smoke in them.I tollerate smoking on my deck or carport but not inside.
I smoked from the time I turned 13 until I was 43,and now 11 years later I still do not smoke.

Your home, yes, your car and "etc" which might include MY workplace, NO!!! You do not have the "right" to pollute my air, and to expose me to second hand smoke. Do you (like so many smokers) hold your cigarette out the window when driving/smoking, do you throw your butts out the window? What part of that sounds like the right thing to do. If people were considerate with the smokes, we would not be have such a problem with it.

I agree 100%. I can see banning it at work, or in public places, but a person should be free do do whatever they want in their own homes, or cars.

Yes I do, lets open smokers-only pubs, clubs and restuarants!
If you don't smoke you don't come in unless accompanied by a smoker. It's just as easy for us smokers to discriminate but we don't we're COOLER!
