Seems like then they can take away the employee protection argument and it would be legal to advertise "smoker needed" as one of the job requirments.

Just my opinion but the government needs to stay out of the business of running peoples lives. I feel if the owner of a bar or restaurant want to allow smoking in their place of business it is just that their business. They will be responsible for any damage that occurs. If I choose to go to this business either for work or enjoyment that is my business. I do not need the government to tell me I can't do these things because it is bad for my health. What ever happened to personal responsibility? I don't need a nanny and this is what the government is becoming a nanny state.

I don't think that a bar owner should only employ smokers but I do think that bar employees should realize that cigarette smoke, no matter how disagreeable it is, is a part of the job. People smoke in bars and if an employee doesn't want to be exposed to the smoke then they should seek another line of work.

Good thought but it might get ugly if a non-smoker filed a discrimination suit against an establishment. These anti-smoking lobbies have the best lawyers money can buy and politicians in both major parties on their side practically everywhere despite the negation of personal freedoms their agenda supports.

I don't use tobacco in any form but I'm beginning to think that the non-smoking nazis are getting worse than the Taliban. The government needs to get out or regulating people's lives like that. Stupid liberals.

Once I realized I was smoking more when I drank, then I quit drinking and smoking. Don't give in to mass brain washing. No it's the law try to obey it.
