I Have been with a company for 1 year including my 3 probation months. Does that count or is it from when i signed my contract, that you count 1 year. because i need to resign and want to know how long notice to work. My contract says 3 months, how can i get out of it.

1 year from when they employed you. Your probationary period counts. Most companies have an open door policy....you should only have to give 2 weeks notice......if you want to be nice.

Since you signed a contract you are an AT WILL Employee and thus you have access to all guidelines in the area of criteria for termination. Since you passed the probationary period all you have two do is give a formal resignation letters, but it depends on you position and some companies require people to wait until a replacement is found.

Your contract should spell out whether your obligation is from the hire date or the end of probation date.
