My spinster aunt died recently leaving 3 houses and a large amount of money to me, two cousins, and her sister-in-law. One of my cousins is attempting to keep the rest of us from our inheritance. He was executor at the time of her death, and I have no idea who the lawyer was involved in setting up the will. I have obtained my own lawyer, but so far we can't get information about the will. Any ideas on what to do?

The will has to go through probate. If your cousin hasn't filed the will for probate, get your own lawyer to make clear that this needs to be done. An executor is not a power unto themselves. It's up to them to legally follow the strictures of the will - what they want does not factor.

Justice, I have no idea. You did the best thing that I could think of and obtained a lawyer. But I have always thought that the executor was to see that the wishes of the departed was to be done not to take away the money. It seems funny to me that they are keeping the will from you unless it is something that is going to hurt his case. Have your lawyer get a copy of the will ASAP. I think you can file your will with the state, so that would be one possible way of getting a copy. Otherwise, you may have to talk to your lawyer about going to court.

Have your lawyer send them a certified letter (They have to sign for it so you know they received it) stating that they are your legal counsel and they have 10 days from the receipt of the letter to produce the will or legal action will be taken against them.
