How long does divorce take it going on 4 months.We have 2 kids,
We both want custody.I live in the city my wife live in the county with her parents.Right now my wife pays me child support. She
hasn't pay me seens it started 3 months ago.She has a lawery
her lawrey tells my wife to pay something on the child support.(she refuse).Then my wife file for custody and child support against me in the city circuit court without her lawery.The kids stay
with me 5 nights a week(schools nights).She has them on the weekend.My lawrey talks to her lawery,My lawery telling me,Her lawery is saying my wife feels she don't have to pay child support or day care. She claiming that she's the primary care taker.
I'm talking to Co-worker,They're telling me the judge will ask her she lost her mind.* You're behind on your child support.*you have the kids 2 night out the week.You're asking for child support and custody.The Co-worker are saying the judge might though her in jail for not paying child sup

The judge order her to pay me child support.She start crying and tell the judge no one has custody.To this day she hasn't pay me.(4 months in the rears).We try a mediator once with both lawyer.Now she filing for sole legal and physical custody and child support against me with out her lawyer.My lawyer thinks she nuts for doing that.She still see them the same amount of time as before. Within 3hr she give the kids a shower and feed them over her parents house.

First, if there is no court order ordering her to pay child support, then there is nothing that can be done if she refuses. She can only get into trouble if there is an actual court order specifying who has custody and who visits and pays child support. Since your divorce is not final, there is no final divorce decree which spells out everything. You may have a temorary custody order in which she is supposed to pay but is hard to enforce. Unless you can prove her as unfit most courts will grant custody to the mother. Am not quite sure what your lawyers are doing here, but glad I dont work for them. If you had the finaldecree, she probably would see jail time for not paying but I seriousily doubt if it will happen now. Need your attorney to push this into court quickly and get the final judgement on everything

It depends on where you live as to how long it takes to get a divorce some states require a separation period before you can file.In the mean time someone needs to be appointed temporary custody.If the kids are with you the majority of the time then you are the primary care taker.If she has been ordered by the judge to pay you childsupport and she's not then she has violated the order and yes she could be held in contempt.Good luck and hang in there I've been through it myself.

There is time limit on how long a divorce can take. Child support is ordered by the court.The only way to stop that is by another court order.The reason why your wife filed for custody without her attorney is possible because he wouldn't represent her because she doesn't have a chance. If you have your children 5 nights a week be happy what more can you want

You and your lawyer should persist on getting that child support. If it is ordered by a court she has to pay it. There are many penalties that could be handed down. Yes one of them is she could go to jail. Another is they could start garnishing her wages until she is paid up. One way or another the judge will force her to pay what she owes. Good Luck.
I was in the same situation but my ex and I decided to reconcile. I am not worried about the back support any more as she is helping provide for our son right now.
My mother says I should insist on getting the back support. But I don't see any need in it since we are getting back together. I think my mother just wants to cause problems. But that's another story. Hope everything works out for you.

Do you have a temporary child support order? If not, then no she won’t go to jail. And even if you have one, it’s more likely the judge will simply chastise her than send her to jail.
Also, do you have a temporary custody order? If not, then you need one!
Custody disputes sometimes drag on a long time and sometimes get very expensive. It just depends on the case itself.

It can be a VERY long time. My custody hearing lasted almost 3 years. She kept leaving the state and disappearing for months at a time then coming back with new lawyers ect.... It can take forever and loads of cash....

ok first of all how possible spell and observe issues top . What u . s . a . are you from ? Is that why you married her so which you will be able to desire to come over right here and get divorced ? I mean cmon you are the guy who married her and you're purely now understanding that she is able to this . hear it is the mummy of your toddlers you think of that it is sweet for her to be in penal complex ? i think of you the two are unfavourable examples of dad and mom . i believe sorry for the toddlers with you 2 as dad and mom!!!!

I don't know how long it is going to take. Each divorce is an individual case. Mine took 6 months but we didn't have any court battles. You are obviously doing major battle which will make the entire case longer. No one can tell you how long...
