My brother has a hearing date coming up for his appeal on his disability. The atty that was hired does not seem to care one way or another if we win or lose. Shows no interest. Is there a way to postpone the hearing and consult with another attorney? The hearing is set for Monday.

You could go to the hearing and ask for an extension so you can consult a new attorney.

The answer really depends on the rules of procedure for the forum where the hearing is being held. . I have seen circumstances where a clients have hired a new attorney and were able to get a postponement of a hearing or a trial date, but I've never seen one on such short notice. You have to keep in mind that the schedules of many people have been arranged for this hearing to go forward: the attorneys, witnesses, doctors and the judge/hearing officer. You can just show up on the day of a hearing or trial unless you have a very compelling reason to do so.

I believe so. I work for a law firm and you can do a substitution of attorney. Call tomorrow your states bar association. For example I live in Cali so I would go to the California State Bar website find the number explain my situation and they would refer to a suitable attorney and thus postpone the hearing. It's call Lawyer referal service which is free. Hope this helps. Good luck.
