he tried to leave the scene with my grandaughter trapped in the truck, he took her cell phone and called friends to come and get him, never once called 911. she is still in the trauma unit. i want to know why this guy was not arrested for driving while on drugs. witnesses said it was vey clear he was wasted. is there a law against this and why havent the state police in pa done anything.

PA is one of a handful of really screwed up states in this regard.
He should've been taken to a hospital where toxicology reports were generated, then he'll get court dates, months from the accident date, aqnd he is free to keep driving until he is convicted and his license is revoked.

Last year my brother got 3 DUI's in a 18-day period, and on the 3rd DUI he hit a cop car and his BAC was .24 (3 times the legal limit). By the time I got to the hospital they had taken his blood and let him go.

Now it's 4 months later, he went to rehab for 2 weeks, moved in with me and has almost 4 months clean and sober. He won't lose his license until his court date next month.

My family had wondered the same thing, and were outraged that he wasnt immediately carted off to jail.. Write your senator so we can make the roads safer and people accountable for their actions starting at the time of the infraction.

If my brother wasnt clean now he would still have a license and could possibly kill someone from DUI... It's crazy.

The police can not arrest someone for driving under the influence of anything based solely on witness testimony.
The officer has to witness behavior that would be evidence of driving under the influence.
However, I would certainly think felony hit-and-run would be an appropriate charge if he tried to leave the scene of an accident.
And even though the police and courts might have a very limited criminal case against this guy, I believe you could still go after him in civil court, so I would agree with previous answers; get an attorney.

You definitely have to go and seek legal advice!! he needs to get done for that, and as far as i know he can be prosecuted for driving under the influence of drugs, what's more is the police can trace the calls he made from her cell phone and the time they were made, and you have witnesses too! and the police should investigate in depths all the events that unfolded before, during and after the crash! How do you know the other driver was on drugs?

Although I dislike lawyers & lawsuits you will indoubtedly have some serious medical bills coming up. If the other driver is responsible, he (or his insurance company) should pay these bills. A good attorney may be necessary.

sad to say but "got proof" you could do anything while on drugs or after drinking heavily run and hide for awhile until its out of your system then show yourself and all you could be charged with is the accident if the cops went to find him and he wasn't wasted when he was found they can't arrest him for it all they can do is charge him for leaving the scene of a crime which doesn't get a big enough punishment in my book.
