If it is accessable in a area that you are allowed and no reasonable attempt has been made to prevent you from accessing it then yes, It is legal.

I don't think any government has passed any laws against using an unsecured WiFi network. But think of it like this you are using the Internet without paying for it if you are using a WiFi network other than a designated hotspot.

Nope, in the USA, if it is open you may use it...however, play nice and do not surf sites that might harm the server, such as porn or sites that may be illegal.
