in the struggle the man drop the nife, the kid who is also in the room pick up the nife and after year of getting abuse and seeing his mother get abuse. He decide to stab his farther he goes at him with the nife and the mother gets in the way and he kills her.would he go to jail or would the dad.

Both. You could lead into something very devious with the kid. He could have plotted this and he has evil plans. There is alot of twists and turns you can take.
Dad does defiantly go to jail. Or maybe he steps up realizing what he has been doing and takes the fall for the kid. That could lead to the kid falling apart and eventually telling the truth.
If they know the kid was involved in the stabbing, depending on his age yes he will be arrested. If anything he would be taken to social services....

Oh Carlos! That is a hard one, only a jury could decide. However, during the years of abuse the boy should have tried talking to a favorite teacher, or a priest even if he didn't know him, or social services , or the police, anybody and everybody until he got help. Also, the kid really needs to go to school and do his very best - study, study. He can make himself a great life. How do I know? I did it!!

We'll since your a writer I guess you should know how to spell KNIFE & FATHER!
I would think the father would be charged with assault... but the son would be ok.. cause for one thing he's a young offender, and for another, you could probably argue self defense, and his mothers death accidental.
