I have been custodial parent for my son since age 3. I provided sole care, medical, dental, etc. He graduated HS in May 2006, at which time his mother quit paying child support. As he lives with me(age 18) I still pay medical, dental, college tuition, car ins. and provide him room and board. The ex says her son is an adult and she isn't paying for anything outside of half his tuition. Can she just stop paying her child support if he is a full time student still living with me? She makes (and always made)a lot more money than me and paid WAY under the usual child support as I had an inexpensive lawyer at the time and she still lived in the same state. She moved to TX a year after the divorce and I and my son still live in MO.

i have been told that regardless of age as long as child is attending school or college child support is still maintained through law. Check with your state laws

I hate to say this, but child support is collected only until the child reaches 18. If she stopped paying before 18, then you can collect any remaining payments. If she stopped at 18, then you can't force any more support. If the latter is the case, then I would just let her be a bad parent, your son will see what's happening. I have an aunt like this, except she never payed support for her kids (she was so horrible, her own son now stays with his stepfather, my uncle, instead of her) I will say that it can be difficult to get a woman to pay child support. They think because they gave birth, they don't have to pay if the child doesn't live with them. Get a good lawyer and see what you can do. Good luck.

Unless she owes back support for the time prior to age 18, she only owes support for college tuition, and some states don't even do that(being as the child is an adult). The court at the time stated how much she could pay and as long as she paid it, she's fine. You never appealed it. He's an adult now. He can get a job and at least pay for his own insurance.

First off, you need to find out if the courts declared your child emansipated or not. If so, and your count papers say so then no she can not stop paying. THat applies if there is back child support. But if court papers state that she pays until your son reaches age 18 thats it regardless of what your still providing.

In Texas, child support ends when the child turns 18.

Does your divorce decree say that child support goes to 18? Or until he is no longer a full time student? Start from there- you know what to do after that!

The answer is no she does not have pay pay child support after the child graduates high school. You are lucky she is helping pay for tuition, a lot of parents stop everything after graduation. The best chance you have to get more from her is for you to direct you son to go directly to her when he needs more. It is one thing for her to say no to you but if she directly refuses her own child of their needs that is another matter.

if she was ordere to pay while he was still in school, she should be paying. check your decree. you may call your child support agency for help in collecting.
