Because in absence of any other point of reference, all the other orbital planes are measured by how far from our own ecliptic they are.

It's basically like using a system of measurement for people's heights based on 'taller than me' or 'shorter than me'. Most people are shorter than me, and there are some who are taller than me, but there's no particular signficance to the fact that I am exactly the same height as myself - since that's my baseline measurement.

Because we defined our coordinate system that way. It's our orbit and we can do anything we like.
