lawyers come on tv all the time saying if you were in an accident call us so we can sue the insurance company, or if you were hurt on the job call us so we can sue.The lawyers get millions while the person in the accident or hurt on the job gets pennies.Then the insurance goes up to pay the lawyers, and also people who aren't really hurt are encouraged by these ambulance chasers to claim they are hurt so they can get paid, all at the expense of honest citizens.That is how Edwards, the punk from NC who is running for president,got rich.

I work in the administrative side of health care and I can assure you, without hesitation or doubt, that lawyers and lawsuits are not the factors driving up health costs. I am sure Rush Limbaugh told you differently but truth is that all that tort reform crap is just a way to insulate insurers at the expense of ordinary citizens many of who have been serely hurt by real malpractice.

You aren't a partisan are you?

If lawyers would quit with the FRIVOLOUS malpractice lawsuits over stupid things, then maybe the malpractice premiums would be more affordable for physicians and therefore they would not have to raise prices, which in the end is what started alot of this problem with our health care system today. If lawyers would only sue a doctor/hospital for legitimate negligence and issues then maybe we can make some foreground. Until then, malpractice premiums will continue to go up, prices go up, health insurance premiums go up, and Americans get deeper into a health crisis!

Yup. Insurance for malpractice is huge. Medical care is just like any other business. When a expenses go up, they are just going to pass that on to you. Suing everybody for everything just causes the cost of everything to go up. In the end, we are only hurting ourselves when we sue other people.

I am not saying that all law suits are bad. But I think that 90% of them should be thrown out as frivolous and stupid.

Oh, please -- get real.
Do you think if lawsuits went down the health care providers would magically lower their prices? Of course not -- they'd keep them the same, and just enjoy the larger profit margin.
They're in it to MAKE MONEY, not to give a darn about you and your health. The vast majority of lawsuits are trying to address patients getting a raw deal *because* of that goal of profit.

Oh, and your assumptions are way off -- lawyers that do these kinds of cases take at most 30% of the award given to the patient -- the patient ALWAYS gets more than the lawyers do.

Maybe if the insurance companies did not try to screw people over like in Miss, and La, after Katrina on paying all of the claim we would not need them. You forget corporations are not people and do not have feelings.

The blame lies with the idiots who get the money, not their lawyers. No one forced them to hire a lawyer. They need to stop. The lawyers are merely doing their job, representing their client.

Of course they do. Everytime you win a settlement for medical malpractice, the doctor's or hospital's malpractice insurance pays for it. As a result, companies that sell malpractice insurance must raise premiums to pay for some of these huge settlements or judgements. Increased premiums for doctors and hospitals means increased cost for the services they provide.

While there are reasonable cases of medical malpractice, I think that there are a number of unreasonable cases too. Controlling this aspect of healthcare is part of controlling the overall cost of the service.

Yes for many of the reasons you have stated. Lawyers drive up the cost of everything because they sue anyone and everyone, that is how they make money.

Lawyers don't sue doctors - people hire lawyers to sue people......see the difference?

Too many people see lawsuits as a get rich quick scheme.

Yes, They cost everyone who seeks medical care.

They drive up the costs for insurance for doctors
That drives up medical bills
Inturn that raises medical insurance rates

Hopitols have to hire lawyers to defend them
Doctors are not free to try drastic attempts to save lives

Old, experienced doctors quit rather then deal with the stress. That leaves us with less experienced doctors who are overworked to keep in the black.
