There should be no need to have to hire an attorney and lose 25% of your pension when you file for disability. I know several people who can't work and are in danger of losing everything because Soc. Sec. will not grant them the pension they deserve. The entire process should only take one month to resolve not a year or longer. People can't survive that amount of time with no income and no ability to work. This is a disgrace for our country. The opinion of two or three doctors should be all that is required to grant the claim. Most people who file are entitled to the pension and will eventually receive their money but in the meantime they lose their houses and their families break up from the stress involved. This is not the way it is supposed to be in the United States of America. We are supposed to have the right of life, liberty and the persuit of happiness. The government denies us those rights when we become disabled and we are denied our benefits for years.

It's probably this way because of so many people scamming the system by claiming to be disabled when they're not.

If you would review your medical records, you would probably see that the treating physicians are recommending like most doctors do that they will reevaluate in 6 weeks. The definition of Social Security Disability is "The disabling condition has to be diaganosed or expected to last at least 12 months and prevent you from doing any work that would be considered substantial (Substantial Gainful Activity Level for 2007 is $900 month for non blind disability). Therefore, when the medical records are reviewed, it only appears that your physician is saying 6 or 8 weeks at a time that you cannot work. Therefore, a person would have to be off work for the disabling condition for 12 months before they meet this definition.

Just a matter of record. Social Security Disability is granted at the 1st filing for over 50% of all disability claims taken.

Because the ones making the rules (Congress) were mostly lawyers...wait until amnesty is passed & Bush signs the SS law into affect for illegals...you think it's bad now....they will only have to work for 9 quarters & can receive all benefits - including survivor benefits & the checks can be sent to non-citizens living in mexico.....
Just another reason we must all join together to stop amnesty....they don't just come to work but rather to work the system - and Americans lose! Write Congress

The Social Security Administration uses fairly objective criteria in determining eligibility for disability benefits. It takes more than just a doctor's note to establish eligibility for benefits.

The SSA can also have you examined by their own doctors and they may disagree with your doctors. It takes time to get your hearing and you have the burden of proof to show entitlement to benefits. You don't need a lawyer and there are plenty of volunteer lawyers and other professionals who might be willing to help you. And if you prevail, you will receive back benefits going back to the date you initially applied.

You are so correct. I have Rhuematoid Arthritis in 87% of my body, and am in constant pain, if I do not take my medicine. When I do take my medicine, I feel like a walking Zombie. I have been denied Social Security and am now waiting on the appeal. I have not hired a lawyer yet, but the System is gonna force me to do so. And yes you are correct, it is not fair.

"Most" people are entitled when they apply?

Think again - you think you're appauled at the system, you would be horrified to see the crap that people try to pull on the system. It's a disgrace that lazy, pathetic human beings are screwing up the system for the truly injured.

it took me two years they have actually improved the process. By the way hope your friends are frugal. you only get 623 a month on disability. Gotta love that scam. If someone knows where I can get a job feel free to tell me.
