My former boss told me not to contact her anymore because I quit- Good reasons as I had a baby and told her i couldnt work any over time unless given an advance notice- but wouldnt mind helping out if it was necessary.

3 days in a row the person that was supposed to relieve me never did so I would end up working 7 am until 9 pm when the person relieving me decided to show up.

Anyway I called to ask her and she told me not to contact her because she is upset with the way i left. Dont I need to know if i have to pick up my W-2 or is it being mailed. My husband is 1099 so we just want to get this taken care of and file and pay what we will owe.

I know they have until the 31st to mail out but i was just wondering how it works and what do i do if she dont give me it

Also the reason i asked she refused to give me my last pay check that is why I am worried too.

they have to get it out by jan 31. if a big company usually personnel department mails out to ex-employees. Even smaller companies often use a payroll type firm to both pay you and also compile and send out the w-2. If somehow it goes to your boss or is prepared by him, and they don't forward it on (seems unusually spiteful), first week in february send boss a certified or even registered letter with return receipt, say you will be notifying IRS that they are refusing to provide w-2. If you have last pay stub you should be able to get the basic elements needed to try to do your taxes unless there are unusual complexities, and when you do so just include statement about employer refusing and attach copy of pay stub. If you absolutely can't do taxes without, call IRS and ask them what to do.

It's unlawful for them NOT to mail out the copy before 31 Jan. (Sorry winzip..but all employers must get their W2's out by the end of January---or make "reasonable" accomodations for their employers to get a copy---it's the LAW). They must get that copy to you. If they won't--then you have a right to file a grievance with the IRS.

Only employees have the privilege of getting their W2s @ work, so look out for the in the mail. If you think she won't send them, call the head of HR or another employee to find out if they have been distributed.
