I asked, earlier.....He is incarcerated now, but was a dependent! He will be home in a couple of weekes! He's only been in there for 3 months

Did you provide support for him for over six months? If not, then don't even bother asking a CPA. The answer would be no.

The likelihood that you can count an adult, who isn't incapacited, as a dependent is very low.

It might be very risky if you did this. Did you claim him before he went to jail? I would have to know that before answering truthfully.

Yes you can, but you have to have his consent to do it, because you have to have his ss#. If you've supported him for 6 months out of the year, then yes.
