He abandoned my daughter and I to pursue his meth use, so I left the state with my daughter to live with my family. Once I meet the state's residency requirement of six months, how can I proceed with a divorce if I don't know where he is in order to serve him with divorce papers?

Most jurisdictions permit service by publication if you've made reasonable efforts to find him. Any lawyer in your jurisdiction can explain the requirements. Usually it involves publishing a notice in the newspaper. How many times depends on the state where you live. For example, here in my home state, you publish once a week for four (4) weeks in a periodical published at least once a week in the county where the case is pending.

The problem is that your state may not be your child's "home state" as that term is defined by the Uniform Child Custody Jurisdiction Act. Please talk to a lawyer to find out if you can get a custody order if you haven't been in the state very long.

Try: zabasearch.com That may help in locating his whereabouts. However, if what you say is true, he's probably not interested in being 'found'. Thus I'd enlist the service of a good divorce attny. If he's unable (or refuses) to be found, the court will take care of such things. My X was served. But then literally went into hiding. Final decree took 18 months. The court resolved all matters.

If you have his social security number you can try this place called Intellius. You have to pay like $60 and they will give you information on where he is located, phone number, and other such information. You can find it at www.intellius.com. I had to do this when I filed for divorce as I had not seen my husband for more than 2 yrs. For me it was worth the money...just to be done with him. I hope this helps you.

You have to file an ad in the newspaper saying that you are looking for him in 3 of the last known areas that he lived in .Wait 3 months if no reply ..proceed with uncontested

Put an ad under the legal notices in the newspaper where u think he might be stating that your filing for divorce and he has however many days to respond. Im sure he doesnt read the paper so just wait like however many days then your divorce will be final. Trust me, i did it with my ex-husband!

My wife had the same experience. He impregnanted her the night they married and left the next morning. She has never seen him since. It took until my stepson was over a yaer old for her to get her divorce. The judge said he wanted the father to have a chance to meet his son ( a crock of ****).

So it is possible, it just might take a while longer than other divorces.

You have to file papers to his last known address, if they cannot serve him the papers, a court date is still set and you will win by default if he does not show up.

Sounds like he doesn't want to be found. Ask your lawyer.
