How can the defense win in United States v. Morris?

I'm trying to come up with a solid apellate defense for Morris in United States v. Morris and would appreciate any help some of you might have. Has anyone done this before and if so, what's the best approach? The ambiguity of the statute or interpretation of courts? Thanks for any advice!
