ok back in 2006 my boyfiend was charged with bad checks and sentenced to 1-10 yr suspended and received 5 yrs probation instead and to pay the restitution. Well now the place that he wrote these checks to are taking him back to court do to he hasnt paid it off yet. He was giving 5 yrs to pay it can they do that?

there was no set payment arrangement put on this he was just to have it paid in 5 yrs.

I think Robert P almost hit the nail on the head. According to you your boyfriend was given a certain sentence based on conditions. If he has not met those conditions then he has failed to uphold his end of the bargain.

Double Jeopardy and being tried twice is a bit different. For example if I was writing bad checks to a company and they took me to court and I was found guilty. They couldn't take me back to court and try me again on the same checks because maybe they forgot a zero. And it was a 20,000 dollar check not a 2,000 dollar check. That would be double jeapordy and they'd be *ss'd out of luck.

I like the answer about finding an honest boyfriend though. Thumbs up to you. Usually a boyfriend is like a trial for husband. You don't want a husband that can't handle his finances. You'll be living paycheck to paycheck and in debt all the time, and will be struggling just to make ends meet. Now if he's trying and it was just some bad luck that he hit, then you are a great girlfriend for sticking by his side.

Good Luck...Pay your bills. This world is run by money, and people aren't gonna let you get away with short changing them.

And you are dating him because? He will hit you again. He is not even real sorry. Oh well if you want to be like those woman that has to hide her bruises and say you fell over to people. Eventually he will control you with fear and everywhere you hide he will want to find you. You will just be a sad statistic of abused women. He did it once and if he feels he got away with it then it is a heck of a lot easier for him to do it again. He has already commited the act now so the line has been crossed in your relationship. You are in a very risky situation. People who love do not hit each other. I would never lay a hand on my wife - EVER! No Matter what reason, I would NEVER touch her in violence. Dump him, don't waste your time. He will eventually rule you with his fist and you will be too afraid to resist him. At them moment he will beg and say anything to keep you but your single acceptance of forgiving him will to him mean you are willing to buckle to him. 1st stage of his control over you.

The first sentence was a criminal court sentence (lenient in my opinion). The second court session will be civil court. He will not be found guilty of a crime, but hopefully the court will force him to pay money.
So the answer is yes, you can be tried twice for a crime. Once in criminal and again in civil. OJ was a good example. The idiots found him not guilty in the criminal trial, but a civil trial found him guilty and forced him to pay money (which he never did)
By the way, why not find an honest boyfriend?

Yes. I'm sure the judgement included a payment plan, and my guess is he isn't keeping up with it. If the judgement is set aside, he could be heading to jail.

if he was given that amount of time to pay it off he will not be prosecuted...the Judge has imposed a settlement.... but if he is late to make specific payments he is in violation of his probation..he will go to jail!

People charged for the same thing twice is called double jeopardy, which is illegal. However, if he isn't making the payments, he needs to suffer the punishment.

yes they can as he has not paid for the checks off, then yes they can.
