I want to claim him, but he's incarcerated.

and just how would he qualify as a dependent...assuming he is an adult 18 or over????

I don't think you can claim a boyfriend on your taxes, regardless of his incarceration.

You can claim him as a dependent on your taxes if you provided care for him for at least 6 months of the year. If he's in jail the tax payers are providing for him - not you. So basically you'd be committing fraud.

How could you claim him anyhow? Was he a dependent? IF so, sounds like he was a loser to begin with.
