My Grandma is very sick. She's been having a lot of strokes and been in the hospital for awhile. We don't think she's going to make it much longer. There's been alot of dispute going on with the family because my aunt is already spending her money...has her condo and car up for sale and she hasn't even died yet! Well my mother and other aunt had an investigator look into this and the police as well. The investigator ordered my aunt to fax the will to my other aunt and my mom. She did that but my parents said that they can tell the page numbers on the will have been changed and there should be 6 pages and they only received 4. Also the name of the lawyers/witnesses are not real. What can we do about this and who do we contact? My grandma and aunt is in Florida and the rest of us are in Michigan.
Any advice would be appreciated! Thanks!

Since your grandmother is still alive, none of the will's conditions are related to this. If your aunt doesn't have a power of attorney, or a judgement from a court, she can't sell anything that is in your grandmother's name - that would be fraud at best. Contact the local police and tell them about this.

You should also have an injunction served on her to stop her from disposing of your grandmother's assets. Contact a family lawyer to arrange this.

You can also apply to the court to be appointed conservator for your grandmother to protect her interests. You would then have control of her assets while she is sick. Again, the family lawyer can help with this.

If a will has been altered, or the witnesses and attorney are proveably fake, then the will is void; in which case, when you grandmother dies, the Probate court will determine how to dispose of her property.

While I have no legal training, I would think that your mom and her sister in MI should get a lawyer and see a judge to freeze your grandmother's assets until a proper evaluation of your grandmother's will. I would think that the best idea would be to go to FL and have your grandmother either confirm that the will has been tampered with, have her sign a new will or to confront the aunt. Either way, this is going to get really messy and I think it should be noted that you should be proactive in trying to make sure that this problem doesnt break up your mom and her sisters. While I dont know you, Money is the root of all evil and is the main source of conflict between relatives.

Pages should never be 'missing' in a will. Take the will to an attorney of YOUR choice, and have him look it over. He can put a stop to money being spent by other family members, if the money is to be given to someone else. Elder abuse is what this sounds like to me. Elder abuse is when anyone takes advantage of an older person's body or money or anything else the person has. Make out a report of 'Elder Abuse' to the police in your own city, if you cannot afford a lawyer. Elder abuse is very much looked into, when an actual claim is written down, with, in your case, pages of the will missing. Good luck! covenly1@yahoo.com
