Trying to make a quick list.

Can you please tell me some examples of things that are illegal, but where the police will not press charges?

(Where the Activity is seen as culturally acceptable. e.g. students egging cars on the last day of school, smoking pot on a commune etc.)

The laws concerning "arrest" are very specific. A police officer may NOT arrest on a misdemeanor charge unless he witnessed the crime.

Example: Students egging the car....it happened...he can see there are pieces of egg and shell, YOU know who did it...but HE didn't see it happen. In this case YOU would sign the warrant not he!

On a felony offense...it's a bit different...

Example: A suspect has shot and killed someone....the suspect is at the scene holding a gun. The victim is dead! The officer didn't see the shooting itself but has "reason to believe" based upon what he does see...that the suspect committed the offense. In this case he may make the arrest!

Hope this helps you understand!

Best wishes!

Curt is SOOOOOO right. There are a lot of laws that cops don't know about because they are either so outdated or they don't think that it is worth the time/paperwork when the person would be let out in a couple of hours anyway. Lawmakers need to really examine these old laws and toss a lot of them out. Like the guy above that mentioned adultery. Sure, someone is being hurt, but they are not going to die from being cheated on, so it really should not even be on the books anymore.

Here is one for you, adultery is still on the books of most states as being illegal. I believe in Kansas they have not prosecuted someone for this in decades.. In fact I'm sure no one has been prosecuted for this in decades.
It is still illegal, but man, talk about overflowing jails if we had arrested people for that!

We have way too many laws, so they become meaningless. Even to the cops who enforce them.
