Don't allow his ignorance to upset you. You want a divorce, then go and file for one. He has moved out of your home and there isn't much he can do. He doesn't have to sign the papers, but you will still be granted the divorce. Take him for child support because those children are entitled to that money. Don't allow him to call the shots on anything dealing with you or your children. You have been the provider for this long, continue doing as you have been. My ex husband tried to tell me he wouldn't give me a divorce either. I had to wait almost 2 years, but I got it and he didn't have to sign a thing. Honestly I am not sure what you can do in a case like this, I suggest trying to talk with a lawyer who might know how to go about this. I wish you the best, men like this suck. My husband was the same way but when I finally found out about his cheating I packed his bags, left them outstide and changed the locks. Disconnected my phone and made sure that everyone I knew was aware I wanted no contact with him. He actually got the hint finally and filed for divorce from me. I was lucky enough in NH that as long as the divorce was not contested things went smoothly. I wrote a note to the judge letting him know that I wasn't going to court but that I wanted him to grant the divorce. That was that.

File for divorce--he doesn't have to agree. You'll have to prove your grounds. Even if he was in agreement, you'd have to file and do everything else, so go ahead and start the process and by the time to get to the end, he may be in agreement and you can forgo the contested hearing and just have an uncontested on.

Just see an attorney and file. He moved out so you have grounds for a divorce and the only thing he can fight is the amount of support he will have to give you for the ehildren.

Anyone is entitled to a divorce. You don't need his permission nor do you need his signature. Just one year of separation in some states. No matter what he tells you, you don't need him for a divorce. You don't need him in the court room and if you have a lawyer, you don't even have to be in the court room.

File for divorce anyways, Honey. In most states he'll have 20-30 days to respond. If he doesn't, request a final hearing upon his time expiring and you'll probably win everything you ask for by default. If he does answer, you still win. You can still get a divorce with or without his co-operation. Don't let him continue controlling your life.

Are you two separated? If so, then you can file for divorce without his consentment after a year of separation.
otherwise, sue him for adultery. They will concede you the divorce thing. Don't make it for mutual consentment. Besides, you get a lot of benefits if you win the case.
You can later change it for mutual consentment UNDER YOUR TERMS. Don't let him coax you at all. You gotta be strong, believe me. That's what I did.

You husband does not have to agree / consent / sign or even
be available...You can just divorce him, whether he wants it or not.
Check your state laws...
Check with a divorce attorney..
You can do most of this on the internet..
Worst comes to worst, you may have to temporarily move to
a state that has more lenient divorce laws...
