can anyone help with the above, what is the best form of action, ie police? Solicitor? My neice is really concerned that it will become worse what ever way she plays it, the abuser family are aware my neice is a sensitive girl (it is now playing havoc with her confidence ie will not leave house etc), I am really concerned for my neice safety can anyone help thanks.

This is "stalking" and is violation of both criminal and civil law in most states.

If this is happening on school grounds, report it to school officials and demand they take action.

Report the crime to the police. If you can document specific dates, times and actions, that would be beneficial.

Also, you can sue the parents (I'm assuming this involves a minor child) in small claims court...maybe even "big" claims court depending on the severity of the stalking. You'll need an attorney to go to "big" claims court, but they normally work on a contingency basis...they only get paid if you win.

The burden of proof is that a reasonable person would "feel threatened" by his/her actions, and that would seem obvious from your description.

you can take legal action file charges and than get a restraing order the person who is threating her can not with come around her with out being charged and arrested by police. i would tell you to get help at the school at least make them aware of the problem even if they do nothing about it at least they will know that the problem is serious enough to get legal help also restraning orders are free and you can get one at your local court house but i would first speak with police so that they are aware you are seeking a restraning order good luck your doing the right thing trying to protect your neice...

You must document each abuse. Write it down, date it, say what was said. If the person is stalking your niece, there is a law against that. If your niece is being physically hurt, there is a law against that........it is assault. Write it down for the police or give it directly to your district attorney's office when you have serious things happening to your niece. How old is your niece.....that's important. Don't let anyone blame your niece if she has done nothing. Victim blaming is rampant in police depts...........so, make sure your niece isn't doing anything in retaliation, document what the other person does to torment your niece, and take it to your police dept. Thank public education and the busing system for this but remember you voted these jerks into office. Send the kid to a private school if you can afford it otherwise it is all but a lost cause.

You need to get a restraining order. That way if it keeps up, someone will get locked up.
