What you did in both instances was totally against the law. If he can prove he didn't write the checks, which is obviously not going to be a problem since he was incarcerated at the time.
You and your boyfriend will more than likely end up losing in the lawsuit, and once the court see's the pattern of your behavior i would think a judge would be required to issue a warrant for your immediate arrest for fraud and same for your boyfriend.
Karma comes around and really bites people hard, looks like it's found you. In anycase you need to go hire an attorney as you will need a good one to get you the best deal possible.

Yes he can and he will win---You wrote the checks maliciously and with knowledge there was no monies to cover these checks. He can sue you in small claims court for 3-5 x the amount of the checks written.
He can also press charges against you and have you arrested for FRAUD. Writing bad checks and doing it maliciously is a crime punishable by jail or Department of Corrections time.
You did the crime---so you'll probably do the time!
You ask how he can do this....well if you had done that to me I would sue you too!!!

when we do a wrong to someone else it always come back in some way to us. u knew it was wrong to do that, obviously what u did to him hurt him, caused him to do jail time. it is never good to burn your bridges, and hurt people, as it can and often does come back to us. 2 years in prison is a long time to do when your innocent. guess paybacks are a b....
