My bosses secretary and I have had outbursts in populated locations in my company. The reason being, is she always came off highly offensive and aggressive. She also was recently viewed by many co-workers speaking of me and stating that i was absent because of "migraines" and was definetly faking. I do indeed get extreme intense and paralyzing migraines. Do I have any arguement? I work for a privately owned company.

No you don't. Unfortunately, she has a right to her opinion no matter how wrong it is. Why is she attacking you. Does she overprotect your boss?

Do you have medical proof that you get these migraines? Are you on medication? (As a side note, I am very familiar with these migraines, because my mom gets severe ones as well). If so, I think you will have a case that may hold up. I can't give you any definite answer, as I am not a judge or lawyer.

No-one wants to be a dead ducks witness, she is probably in effect only following orders, manipulation from above. If your boss was doing it directly as a woman you could go for the sex discrimination gambit but as that option is not open and your witnesses will run a mile seek alternative employment.

Different states have different laws regarding what is legal and what is unlawful behavior in the workplace. My initial reaction is that, based upon the limited information in your question, you do not have a suit. However, you might. Contact a local attorney who practices labor law and represents workers.

I don't think that its harassment. If I were you , I would stay away from her. She is probably intentionally trying to create conflicts and make you look bad. You should try looking for another job in the meantime.

That doesn't sound like harassment, just slander...and it doesn't really seem worth it to take her to court for that because it costs a hell of a lot of money to pursue a lawsuit.

Document what she says and what time ect... to you.Whatever you do don't make it worse by saying things back at her.
