considering that the traffic case and tickets were thrown out does the insurance company have the right to file a suit and if so how long do they have.

Yes, the insurance company may still sue! As for the statute of limitations, it depends directly on what action they wish to bring against the party charged. For some actions, it is 30 days. For others, it can be as much as a year (or even 3-7 years).
