Four years ago my husband was pulled over by the cops. They searched his vehicle and found 1/4 an ounce of marijuana. He stopped smoking pot within a few months after that. He went to apply for a job yesterday and they said he may not get hired because of that misdemeanor. What do you all think? Do most places look at things like that when they hire someone? He was 20 at the time he got charged.

The charge was drug abuse.

He was never a "drug dealer." He hasn't smoked pot in nearly four years. He also didn't lie on his application. He asked the lady who handed him the application if it would be okay to put the amount of time he's been clean.

All he can do is be honest ant tell the truth. I think most employers would overlook it if he has a good work record and ethic, and recommendations from other employers. And hell yes they will look at things like that.

As you get older, you will learn there is such a thing as being too honest in certain circumstances.Your husband's quandary is a perfect example of this.
Most companies are only interested in an arrest and conviction for felonies. It is an automatic refusal 90% of the time, if not more. Unless he is applying to work for the government a security service or banking of some sort, something along those lines, just leave the misdemeanors off his application. Most companies ask for the info, many, if not most , don't investigate.
Good luck

Well it seems wrong but the law in this country is broad to cover all. The situation where one person has it overlooked while another person does not cannot exist. If the companies policy is for zero tollerence then it must be that way across the board or they are opening themselves up to descrimination lawsuits. If one person is not hired for that reason then all must not be hired for that same reason. Remember the lawyers run this country not us, it may not seem fair but it is what it has become, due to companies being afraid of lawsuits. This is probably not the answer you were looking for but hey, you break the law it is a chioce! And we all know choices are long reaching! Everyone reading this, think of this before you go driving around with weed on you! My dad missed a job over an old DWI conviction, the company told him that due to their policy of zero tollerence they had to be consistent. The company probably has to view weed the same as crack or heroin, they are all controlled substances and he was caught in possession of one of them.

it depends on what type of job he is applying for. If the job requires operation of any kind of machinery that could cause an injury, or if the company just chooses to hold its employees to a high ethical standard he wont get the job. There is plenty of qualified applicants out there and the company may not want to take a chance. It is a lot easier for a company to not hire someone with risk factors than to try and fire someone.

This is not the opinion of an employer or a legal expert. I believe the employer has the right to refuse to hire for any reason. If this is the only record your husband has, I would probably give him a chance.

Not to be an idiot or a butthole but if you don't want to do the time don't do the crime. I don't do drugs because I want to work in corporate America. I went to college and got my degree, I worked really hard, and I never got drunk and drove, or did drugs or broke into a car because I wanted the life I am living now. Sorry.

It most likely depends on the employer and if your Husband can pass a drug test now or not. He has to prove to the employer that he's trustworthy now.

No it should not. As long as he is open about it there should be no problem. Since is has been 4 years, I would have not problem hiring him.
