I bounced a check in June 2005 and didn't find out about it until September 2006, I know I know I should have known but somehow I missed it. Anyway, I had a court date in October to take care of it but they asked that I come back in November. The date in November came around and we were out of state at my father-in-law's funeral and the date slipped my mind. Now there is a warrent out for my arrest or missing the court date. Is there anyway to get rid of it due to extenuating circumstances?

You guys all gave great answers, I can't choose!

Just so you know, I got the warrant lifted by calling the court clerk and explaining what happened. I tried to have a lawyer do it but he wanted me to just turn myself in and wouldn't even try to get rid of the warrant. What an ***, he just wanted the money! Oh well, everything is ok now, thanks so much for the help!

All depends on where you are but... 'round my neck of the woods cases like this are no big deal. Do you have the money to cover the check and any court costs and or fines? Then get thee to the court house and settle up. If they really did issue a warrant for your arrest do your really want to face the possiblity of being cuffed and stuffed at a time that is not convienent for you? Not that there is ever a convienenent time for that!

Anyway, best thing to do is get right in there and take care of it. It is not going to go away. The longe you put it off the worse it could potentially get.

Good luck

What your going to have to do is go to the court house and make a appt. to see the judge. Something like that happened to me and I didn't even know about until I applied for a Higher ranking job(needless to say I didn't get the job) Just went in there made a appt. saw the judge and the Bench warrant was taken off. Continued with the court proceedings and everything was taken care of.

On a side note I' sorry to read about your father- in- law. Hope all goes well with you.

as far as the warrant you will need to go to the court house and take care of it directly (don't worry if the only issue you have is the one check case they usually have bigger fish to fry), bring money just to be safe. ignorance is not considered a good defense, the funeral may help as far as forgetting the court date but this will depend on the people that you are dealing with Good luck

The funeral may be grounds to dismiss charges for failure to appear. You still need to deal with the appearance for the bounced check. You best bet is to contact the court and explain the situation. They will probably schedule a new court date. Be absolutely sure to appear then. Unless you are in the hospital, they are unlikely to forgive another missed appearance.
