if the waiter is the same sex you are, then I would presume he is not gay.
If you want to be funny, and you would not be the first to hit up on the hunky waiter, then tell him something funny - "just your smile,...."
If you are the opposite sex, and want to pursue him, then flirt. Leave a great tip and your phone number - do not pay with credit card.
Waiters are used to being hit on. Sometimes they are hit on by same sex. As long as the tips are good, they do not care.
The best way to flirt with a waiter is to ask him where a good place to go after hours is (meaning when he gets off work). Then ask him if he will be there.
