I have a 55 year old only sister that does not work, has been subsidized living expenses by her parents all her life, is a somewhat functioning alcoholic, and has called and left scary and abusive messages on parents answering machine about everyone in the family for several years and vandalized their property when she gets mad on several occasions. They put up with it because well...she is their daughter. She is very crafty and would not admit that she needs professional help.

Now that our parents are getting on in years and won't be with us any longer....any advise what I can we legally and permanently do to protect myself and my daughter from her abuse. (We have a feeling she will need someone else to use as a target for her abuse when parents are gone.) Baring us having to move to another city where she can't find us. Note: Parents are wanting to give me and my daughter Power of Attorney over their estate and this won't set well with her at all.

Most states include in their laws something called "Harassment" or in some states more specifically "Harassing Communications."

For instance in my own state you'll find:

b)(1) HARASSING COMMUNICATIONS. A person commits the crime of harassing communications if, with intent to harass or alarm another person, he or she does any of the following:

a. Communicates with a person, anonymously or otherwise, by telephone, telegraph, mail, or any other form of written or electronic communication, in a manner likely to harass or cause alarm.

b. Makes a telephone call, whether or not a conversation ensues, with no purpose of legitimate communication.

c. Telephones another person and addresses to or about such other person any lewd or obscene words or language.

Nothing in this section shall apply to legitimate business telephone communications.

(2) Harassing communications is a Class C misdemeanor.

So...my BEST advise would be to prepare yourself as you seem to be doing.

Go to the local electronics shop and buy you a tape recorder with a attachable "IN LINE" microphone. Radio Shack will know what you are asking for.

Get a couple of good recordings that meet the standard of "Harassing Communication" and then file a police report for that offense and don't forget to obtain an arrest warrant!

Once a restraining order is in effect, she won't have but once chance to mess that up, and you won't have to ever worry about her again, because she will be kissing the jail walls for 1 year! They do not fool around with going against restraining orders anymore. Why your parents put up with such abuse all their life's is beyond me, poor things! When you look into the restraining order, their is a lot of rules she needs to follow, so it probably won't take long for her to break it! Stay strong!!

wow. The only thing I can suggest, is when she calls and leaves abusive messages, report it to law enforcement. They can't arrest her for just making one call, but if she continues it could be prosecuted as a misdemeanor of harassment. Your going to have to get law enforcement involved. After wards, maybe you can convince a court to file a protective order. Good Luck.

Our legal system doesn't do anything until an illegal act is committed.

If your sister does something then you'll need evidence to take legal action. I suggest getting a simple video security system. You can set one up that is motion activated and works with a decent computer. Have it record onto a magnetic tape drive and you should be fine.

Have her arrest if she acts up. Better still, in Texas, tell her you have no use for her and to stay away. If she tresspasses shoot her down like a dog.

a restraining order and try to convince your parents to file for one too. if she is not enabled,she may seek help.
