State in this context means status or condition. Union refers to the country. The State of the Union is a report submitted to congress of the condition of the country at that time. The constitution requires the president to do this however it doesn't need to be a speech and it doesn't have to be once a year.

The state is the government. With criminal proceedings they are the ones who would be after your father. Technically you would only be a witness for the state.
