My neighbor is totally disabled and she has received a bill from a dentist saying that she has to pay $400 she has no other income but disability SSI. They already turned it into a collection agency. She told them when they did the work not to do anything that wasnt covered by her medical card. (But it seems they did do work that was not covered). Now they tell her she has to pay. Her Sister said she cannot be sued as she is on total disability Im thinking she can. Appreciate any help...thanks

First of all, they most likely will not sue for this amount. The debt collector however will continue to hound her. Surely she knows what work was done at the dentist and approved whatever work needed to be done. In order to get the debt paid she can send in a small amount every month. Five dollars a month might be enough to keep the calls to a minimum.
If she insists that the work was done in error and that she only approved the amount that her medical card would pay then she needs to contact the insurance people...medicare etcc and explain this situation to them. They might either cover the cost or contact the Dentist on her behalf.

Just because one is totally disabled doesn't mean they can't be sued. If the dentist performed work, they have a right to be paid. She should have a copy of the estimated work to be done along with the estimated charges. One cannot expect the dentist to know what is and isn't covered under a medical card -- that is the responsibility of the card holder.

What she should do is call the dentist and try to work out a payment plan after explaining the situation. Most people are not unreasonable if you actually explain to them what is happening. Otherwise, they just think she's skipping out on her bill!

Try the sites below for research on this issue. Make sure to change the state/location in which she resides. The last site is a VERY affordable way to get access to an Attorney/Law Firm. For less than $1.00 a day she can get access to her Legal Rights and get the Legal Protection she needs. This will help her get ride of the bill, collections, and harrasment.
