Need more details to answer this... there is a lot to take into consideration....

the company will most likely be held liable (or partly liable- along w/ the employee) if the employee's action was w/in the course & scope of their work (eg- medical malpractice- Dr. harms someone in the course & scope of their work)

the employer will also most likely be held liable (or partially so) if they are somehow negligent (eg- someone who answered before me said they'd be liable if they knew the employee was doing something dangerous/ illegal/ etc, and failed to act)

There are a lot of factors to take into consideration and obviously I don't know all of the facts, however, it is POSSIBLE a company may be judged liable (gross negligence) if the employee had exhibited similar actions previously and the company did nothing (such as reprimanding, counseling, termination of employment) to prevent future incidents/problems. Even if it is litigated, it all boils down to whether a jury would decide, based on all of the evidence, whether to find the company liable. Andrea

It depends. The company is responsible for providing a safe workplace. So if the person who commits the assault has a history of violence, or employees have already let the company know that they are an issue, the company can be held responsible for not removing a known threat from the environment.

Your company should have a lawyer who can tell you the specific liability that your company is open to, in regards to your part of the country.

If they have been made aware of the behavior and they did nothing about it and it happened again, they are legally liable.
