Lets suppose that a company offers you a permanent full-time salaried position with them. You have an upper-management title such as Director. They offer full insurance to cover you and probably a percent for your dependents. But they do not provide sick leave or vacation to you as part of your employment. I was just curious if this was legal or not.

I know that contractors, because they are hourly and paid per hour, may or may not receive sick leave or vacation but I've never heard of salary positions, who are full-time, not receiving these benefits.

The long and short of it is. Yes. Sick leave and vacation are considered benefits. Companies are not required to offer either. That being said, most companies do offer them because people would not work for a company without benefits.

Question to you. If you're contemplating working for this company, why? There are many companies out there that offer benefits such as vacation and sick time.

Depends on the company and their policies. They legally do not have to offer you sick leave or vacation time. I knew because I work for an attorney and I have no insurance, sick leave or vacation time. I rarely get holidays off such as Martin Luther King, Jr. Day, New Years Day, and Labor Day which are nationally observed.

not 100% but i do believe it's legal. lots of employment contracts that are written give the option of taking sick leave and vacation or a higher base salary.

US has the most dismal vac and sick leave policy in the industrial world.

It's completely legal....sick time and vacation are considered perks, not rights. As long as they don't prevent you from taking time off or using FLMA if needed then there's nothing illegal about it.

Yes......they can pay you in lieu of vacation and they don't have to pay you if you're off sick.
It is totally legal.
