I purchased an Item off of Ebay the Auction listed NIB and Never been opened. When I received the item it was obviously opened, none of the wires had the twist ties and all the seals on the bags were broken. I purchased it using the BIN price and there were others that had the same price I just picked one. I paid $100 over retail and I'm upset about it and don't know what to do. I'm just looking for some advice. It does seem to be in good condition I’m just upset that I was lied too. It just doesn't seem right. Oh and it was supposed to come with a receipt which it didn't.

Unless there is something wrong or missing, there isn't really anything you can do about it. You can file a complaint with Ebay, but I don't know that they would do anything since you got the item you wanted.
You could also contact the seller and see what they say.

If it was misrepresented you can definitely file a complaint. Decide what you want to do though because it will be a waste of time to complain if you're not interested in sending it back. Ebay wont refund you if you want send it back. You will probably be stuck with the return shipping charges and possibly the original shipping charges (depending on the terms of the auction which you must read VERY carefully). I have used ebay for many years and almost never get burned because I am VERY picky about those I do business with. The feedback rating system is your biggest asset. 98% or 99% sounds great but that means that 1 or 2 out of every 100 people this guy does business with gets screwed. That's still a high number. Things happen but it's nice to work with people that are honest and flexible by looking at their track record. Also, what the heck did you pay $100 over retail price for?? Good luck!

Hi! eBay will first require you to resolve the dispute by contacting the seller directly. Does the item look new? It can still be new even tho the twist ties are off. Unfortunately, if you try and file a dispute with PayPal if you file as item not as described they won't give you any sort of refund. You would have to get the seller to agree to give you a partial refund if that is what you are looking for. So you will have to resolve through the seller first.
Another good resourse for this sort of thing is to go to the community boards on eBay. The people there are very knowledgeable and can help you pretty fast. Good luck!

Looks like you have grounds for getting your money back. First, you should contact the seller by email and try to resolve things that way. If that doesn't work (i.e. the seller doesn't respond or refuses to give you your money back), you should raise a dispute in Paypal (assuming you used this method to pay) and log a complaint in ebay.
I have just gone through this process myself and it takes some time, but it is generally pretty civil. If the seller is any good, they will refund your money. Paypal is usually good about refunds if the item was significantly different than the description, which it sounds like yours was - brand new vs used.
To try and avoid this in future, you should check the rating of the seller and customer feedback given. Of course, this isn't always a reliable indicator of the quality of seller, but it does help a little bit.

You should have just paid retail.. You can give them a neg or let it go and consider it a lesson learned..I'd let it go..No sense crying over spilled milk, hopefully it works
Auctions do seem to run up the price.. I go private party whenever possible..http://craigslist.org
Last summer I was looking for roof mount carrier for my blazer and bid $100.00 bucks on ebay that was all I was willing to go..I was out bid and checked craigs list and bought the exact same thing for $25.00
In auctions you need to set a limit on how high you will go..You never know when the seller has a shill jacking the price up on you..

First check the sellers policy on refunds. Send them an e-mail and let them know you are not happy with what you received, they may have sent you the wrong one. They may rectify the situation, possibly giving you your money back. Then you can go purchase it for retail price. If they do not help you, the only thing you can do is report them to E-bay, and leave negative feedback. try contacting the seller first, they should do something to rectify the situation.

Contact the seller and let them know you are disappointed and that the description was not accurate. If they know you are unhappy they may offer a partial refund, a fair amount that you both can agree on. Let them know that you want to give them a chance to make this right before you leave feedback (or have you already left feedback?). If they don't seem to care about customer service and make some amends then leave negative feedback and report them to ebay.

You need to enter a complaint / appeal with eBay. The item received was not as described and they will conduct an investigation. Also contact the seller to complain.

Definately contact the seller about the incorrect listing. It is not as he stated in his listing, and he should at least give you some cash off. Also ask for him to send you the promised receipt.

I am pretty sure E-bay would have a complaint department if you get no satisfaction from the seller. So try going on line again to E-bay and letting them know what happened and I am sure they can advise you what to do especially if you paid it with Pay-Pal.
