If you can recall what Former President Clinton said when he was being questioned about Monica Lewinsky, he did not believe oral sex counted as "real sex". While I don't agree with his definition, I would say anytime there is direct genital contact resulting in or attempting to achieve a climax, whether protected or unprotected. I think that is fairly close to the "legal" definition in most states if I am not mistaken.

I think that varies from person to person hey...
For some, first base would be "sex". For others, ONLY vaginal penetration counts. (I know someone who would only allow anal penetration in order to stay a virgin - I ask you!!)
So I guess that's up to you.
