I have order some goods from a wholesale company. I paid £35 for delivery, I asked them to leave the order in the garden.
I wasn't there when they tried to deliver and they said they need a signature (it doesnt say in their terms and conditions that i have to be there ), now they say that i have to collect the goods ( i cant it's too bulky) or i need to pay £35 for a redelivery.
If i cancel the order they will keep £35 plus £45 for the goods to be returned to them. Can they do that? it doesnt say that in their terms and conditions. so one way or the other i am loosing all my money. and i dont want to pay £70 to get the goods!!! please help.

The money is being paid through a ground delivery that needed a signature? So, this issue isn't with your postal service or UPS, but with the company?

Yes, they need to pay you back! How dare they.

If you have paid for the goods to be delivered then they have not fulfilled their part of the contract. Write to them saying that you are sorry it come to this but they have five days to fulfil their part of the contract then you will issue proceedings through the small claims court (find it in google) for which they will be liable for the costs. There will be a small up-front charge.

They can't make you pay for a redelivery as they didn't check earlier wether you would be available at that particular time to sign.
Ask them to redeliver you for free otherwise you'll take them to court.
