That would depend entirely on what you are using it to down load. Bit Torrent itself is completely legal, but many people use it to download copyrighted material, that isn't legal. If you use it to download public domain files or files the creator has given permission to download, then it's legal.

Bit Torrent is very legal, the illegal part is when one uses material that they do not own the rights to copy of distribute with. I can write a full program in Ruby,Java or any open source code and seed it on the Bit. When it comes to certain works of art or music, that is where it gets iffy.

BitTorrent is a technology, a way of transferring files between users.
What IS illegal is sharing of copyrighted music, DVDs, programs.
You can legally use BitTorrent to share files that are in the public domain or which you have created.
