marriage and relationships. i want to know if my partner now is considered my common law partner bec i've been separated for 10 yrs & my exhusband lives w/ his new family for over 6 yrs now. i've been living w/ my new partner for 4 yrs now so is he called my common law partner?

If you were never divorced- you are still married- no matter how long you have been together-D

Every state and country has different laws on what is considered "common law" spouses, usually depending upon the length of time their is proof that you co-habitated as husband/wife.

However, it is a moot point as long as you are legally married to your ex, your current partner would not be considered "common law" regardless of where you live anywhere in the world and if you should die without a will, will have no legal standing without a very expensive fight that he is likely to lose in the long run.

I presume when you say you have been seperated for 10 yrs.
that you mean you are divorced..
You would have to check state law in which you live to determine
Common Law Marriage rules...
