I would never want to convict an innocent person, but if I HAD to choose, it would totally depend on how guilty the guilty person is. If letting the guilty person go would lead to that person hurting, damaging, or killing other people - that will hurt a lot more people in the long run. I hate the thought of bad people walking the streets, and there is just too many as it is.

While you wouldn't really choose to do either of those, the judicial system in the U.S. has decided that the "lesser of the evils" is to let a "guilty" person go. That's why the burden of proof is on the prosecution -they need to show ("beyond a reasonable doubt" in a criminal case, or "by a preponderance of the evidence" in a civil case) that a person is guilty & if they don't the person is proclaimed "not guilty". This is the basic tenet known as "innocent until proven guilty".

B) Let the guilty person go because you can always catch them next time when they make a mistake or slip up. I wouldn't want to convict an innocent person because no one should wasted their life behind bars for something they didn't do. Besides, it would always be on your conscience.

That's a tough one, but I would let the guilty person go before I put an innocent person in prison. If the guilty one is like most criminals, he'll be back in jail before long!

That is really tough... it depends on the crime and the probability of the guilty person committing that crime again.
For example, I would prefer to imprison one innocent person than to let go somebody who has murdered and raped many people and who will continue to do so.
I guess that is the pragmatist in me.
