I got a divorce 5 years ago. I was making 15 an hour. I went out on medical leave and they let me go. Now I am working for 6.50 an hour and their still taking half of my pay. I know I have to pay, I don't have a problem with that. Its just after taxes & child support I have little left.

You can have it lowered...You need to file papers with the court, go in front of the judge and they can lower it for you...You need to have papers saying what you make now for proof...You dont need a lawyer, the papers are easy to do and they do have people at the court house to help you...

Unfortuanatley ya gotta hit the courts, good thing its an easy process, you don't need a lawyer you can do this on your won. Also if you can prove the time you took the pay cut as long as you ask for it they can possibly make a retroactive claim and get a bit of a break, but act now you only have so long to get to play with that privelge

You will most likely need to petition the court for this due to a change in circumstances. If at all possible, you should seek legal advice regarding this. You might also try contacting your local child support enforcement office for more information. If the mother is willing, you might see if she would be willing to legally agree to have your CS lowered temporarily. I don't know if you have regular visitation with your child, but it would seem to me to be difficult to be able to provide a quality life with half of your income being eaten up by child support. I wish you the best of luck!

here in canada, there is a guideline set by the government- you must show your gross income and your ex have to show her
there is a table with the gross amount with how many kids then will show you how much roughly what you have to pay.
the other thing is how much time do you spend time with your kid(s) if you spent 50% of the time in one year at your place you shouldn't have to pay. you should see the same lawyer if not, find a female lawyer. may have to pay but in the end this will help

Go back to the courts...with a copy of your pay-stub. (Call the courthouse first to make sure you have all the information they need...more than likely it will make things easier if you bring all original papers pertaining to the original child support agreement instead of counting on them to have them in their files.) They will adjust your payments based on your new income. Good Luck, I know it's a hard situation to be in...I helped my brother out with a similar situation.

if there are any changes, you have the right to request a review hearing (or what ever they call it in your state) to review and adjust any changes.

all states are different (slightly) with child support guidelines; so check the links below.

beware, most states increase for cost of living increases every 2-4 years, so it may backfire on ya... and it may break even (about the same you pay now).

just click on your state and fill it in (the calculator). the rest just click on your state and find the section you need.

File a motion for reduction of support with the court. As your situation has drastically changed they will most likely redo the amount.

Go back to court and get a modification. Plus start looking for a better job.

because you are having a tough time right now you can type up your own papers requesting a hearing and provide neccesary proof of income instead of paying an attorney, or you could contact child support recovery and ask that they help you.
