My ex-wife as of Friday was arrested for dem violence agaist me that following Saturday. The home is for sale and both can legally reside her per the divorce judgement.

In the divorce judgement it states I pay $1200 a month towards all bills hers or mine until closing of the house. It staes she is responsible for the rest. Her lawyer states she can't be in the home so I am responsible for all the bills.

Should I pay the bills out of my own checking account and sue her later or pay the bills from our joint account. Should I hire a lawyer.

(we both had no lawyers for the divorce. It was going that well until this)

Please help!

Follow the divorce judgement: pay all the bills with your name on them, and the remainder of the $1200 pay whatever. Pay this out of the joint account.

It seems morally she should be paying what she was ordered to, but I imagine that was contingent upon her actually living in the house since at the time of the divorce you both implied you were going to still live together until its sold. Now that she's gone, for whatever reason, how do you justify someone paying bills they are not making? She's not making calls so why pay for your calls, if she's not using electricity why pay for your t.v. watching? I know she caused herself to have to be removed, but I don't think you can force her to pay into two different households and as a result you still have to pay for your own which now surpasses the $1200. Unfortunately.

Sorry. But maybe you can file a civil suit in order for restitution and the stress it has caused. But that would seem to be about it. The joint account is risque unless you've been paying out of it all along, and I imagine what you take out of the joint account still has to equal what you yourself put into it since you were ordered to pay out of YOUR pocket. (fine lines, red tape and all)

I would seek a lawyer for legal advice, personally. I posted something recently and had a few law school students reply and they were really helpful.

if you have documantation saying she is responcible for rent she just screwed her self by hitting you yes see a lawyer because it looks like she is still responsible for rent

I would say the divorce judgment still stands..it's not your fault she did something stupid!
