It depends on the state. Also, once rescinded, the custodial parent is made aware that in the future, he/she cannot come back and ask for support if needed. Once you make that decision, it is final.

If in Texas, child support is mandatory. Even if you are not the primary custodian, and have the children with you half the time. If you get divorced in TX, and are a man, be prepared to pay out the @ss. On top of child support, you will have to insure the child(ren), can't claim them, can't claim the daycare, or qualify for the child tax credit. It's BS, I can tell you first hand.

Yes, it is mandatory. It has nothing to do with the custodial parent. They don't have the right to deny the child the benefit of the support of both parents. The only way the claim can be rescinded is if the custodial parent suddenly remembers that the other "parent" is not really the parent at all and someone else is the child's parent.

Only the court that ordered the support can modify/rescind the order. That is easier to do if the custodial parent agrees, but the support is for the child, not the parent.

IF THE COURT HAS ORDERED SUPPORT IT CAN BE RESCINDED BUT YOU WILL HAVE TO PROVE TO THE COURT THAT YOU CAN CARE FOR THE CHILD ON YOUR OWN.

if you have a court order, you have to pay child support or you will go to jail and they will suspend your driver's license if you owe arrears and also attach to your bank accounts.. that's if she is a *****. if you and her have a mutual agreement that you should pay X amount a week or month - it has to be written and you have to send it to CSU. You can take it out of CSU completely. All she has to do is write a letter to them saying that both parties have mutally agreed on X amount of child support per monh or week. She can screw u very badly if she wants to but if you are on good terms with her, try and work it out and take it out of CSU but remember everything has to be on paper. Protect yourself. If you currently have arrears, and she is willing to forget it, she has to write a letter stating that you have paid that amount to her in full.
