As to claiming both of you. He can claim the child no doubt, and since the child is his, he would qualify for HOH (as long as all other requirements are met).
Whether he can claim you or not depends on your local law. According to the IRS he can claim you as long as it does not break any local law. (there are some crazy local laws!)
