I recently auctioned a classic car on eBay. I had several people contact me to make offers and to ask me to stop the auction and sell to them directly, including the guy who ended up winning the auction. The whole concept of bidding on/buying a car sight unseen based on a description and photos boggles my mind, but that's how it went. The winner never came to look at the car, sent his deposit and then brought a trailer to pick it up two weeks later. He only briefly looked over the car, checked the VIN number and compared it to the radiator cover, and then brought the trailer around to load it up. I asked him if everything looked OK and he said yes as he loaded it up. He paid me, we transferred the title, and he took the car. Now he's complaining that the car wasn't as it was described, is saying I cheated him, and is threatening to sue me if I don't give him some of his money back. I told him if he's unhappy to bring the car back in the condition I sold it to him, but no response. Help

Hopefully when you advertised the vehicle in the first place you made it clear and made it clear on your bill of sale that the car was being sold "AS IS."

Those two little words pretty much protect you in a sale of an automobile.

I seriously doubt he will sue you and yet I can't help but see that you tried your best after offering him to return the vehicle for a refund. Very commendable!!!

The car was "as is", and if he signed the title, he agreed to the terms and has no recourse. Now, if you held a gun to his head and forced him to sign the title and load the vehicle, then your butt should be in jail, but since this is not the case, he signed, loaded and left, and its his problem. If you wish to take the car back, you can, but you don't have to, and you do have rights. Good Luck,,,,,,

If you offered to refund his money and he hasn't responded. I would consider the matter settled. Wait until you are actually served before you hire an attorney.
