My son is in the Army and has a 7 month-old boy. The Army is requesting a court order that shows that he is the Father of his child. I have called the county court and spoke with Family Law and they couldn't tell me how to proceed but I was given a web site. http://www.courtinfo.ca.gov.

Specifically, what forms do I need to fill out to get this going?

My son isn't married to the baby's mother but both Mom and Grandson live with me. The reason the Army is requesting the court order is because they didn't get married before he joined and it has something to do with insurance!

There was no adoption, I was there at the birth and I know who the parents are but the Army doesn't.

It is hard to know for sure without knowing why this is an issue. Is the father not listed on the birth certificate? Was the child adopted?

Just guessing, I think it most likely that you (actually, he) want to file a Petition to Establish Parental Relationship. That is form FL-200, listed under "Family Law -- Parentage Actions." You should probably check with a Family Law attorney available at your local Legal Aid.

ADD: Seeing your additional info, I believe that FL-200 is the correct form. He will need to fill it out, and indicate that he is seeking, as petitioner, to be deemed to be the father. Another way to go would be to have HER fill it out to have him (as respondent) declared the father. But again, if possible, run this by a family law attorney.

Army is seeking information,probably, as some one has made request for benefits. Benefits such as housing allowance, medical insurance,
I would seek information from a civil lawyer,and contact then son's commanding officer to inquire as to purpose request made now.
