I assume that you mean 'problem' instead or 'promise.'

There are several issues that would prevent us from ever recognizing that court:

1) Their procedures are not in accordance with the rules on legal procedure set by the US Constitution. Thus - no American person can be surrendered to that court without violating the Constitution.

2) The judges are appointed by their respective governments. Thus there is no true judicial independence as each judge will vote the way their government tells them to.

3) The court has an obvious political bias. Groups/nations that are popular in Europe get a free ride while those who are not popular will het hammered.

4) We simply cannot trust them. Can you imaging what would happen if this court threatened to charge any US service member as a war criminal if the US did something that Europe did not approve of?

5) Our own courts have proven to be perfectly adequate. Absent any specific incident that we do not enforce our own laws - there is no need to have them serve as a substitute for our own courts.
