The question shouldn't be whether it's legal, but rather if it's moral.

The way the US law works is dependance on how that picture is being used. If the use of the picture is journalism, such as an official news story with supporting photos, permissions are not required if that picture is from a legit new source. Copyrighted pics legally cannot be internet posted or reproduced without the authority of who owns the pic. (usually the photographer). If the picture is being used to sell or endorse a product or service, a model realese is required from that person to publish or post that picture of themselves or there property

Lets put it this way - if you happened across my picture on the Internet, you snagged it without my permission and posted it along with some nasty, stupid or insulting comments - I would sue you.
Anyone else would do the same. IF you do this - you make sure you get permission. If you cant reach anyone for permission then you must place a notice that says something like, "If you are the owner or person in any of these images and have not given permission for use - contact me (provide your email address) and I will promptly remove the image(s)."
And make darn sure you are not insulting the individuals you post pictures of. I would be less likely to sue someone who had good comments about me.
There are Privacy concerns AND copyright concerns when you post any images on your web site that do not belong to you and of which you have not gotten permission to use.
Its better to post your own images you take yourself.

Personally I believe it would be unethical without their permission. Not everyone would object, but there are some people in this world who find it uncomfortable to be photographed.
It may also be unwise, in the sense that it provides others with an opportunity to download what you publish and use it for purposes that the pictured person might not want.

Yes, if people are out in public you can take their picture and probably can put it on a website not for profit. For profit, I'm not sure. Probably so, though, since people take pictures of celebrities in public and sell it to magazines and magazines publish to make $. Just don't go trying to take pictures of someone in their house or in their back yard or something, because you'll get in trouble with the law.

You can post any picture you took yourself. However, if someone was asked to pose for the image, they should be told of the intended use. If you took a picture of a bridge for example, and there were people walking across it, then you can certainly post the image on the site. If you persuaded your best friend to dress in a silly outfit and have his picture taken, you would need his permission to publish it.

its not legal, but i doubt that you will be sued for it.
the pictures are not copyrighted, but it wouldnt be the best idea to post them without their permission.
however, if you do choose to post them, just make sure that if the person finds the website and asks you to take them down, that you do.

Does Brad Pitt, Carmen Electra, Denise Richards, Michael Jordan, Beckham and all those celebrities know that we are posting their pictures on our sites?
Are we taking permission from them?

So long as you are not posting the pictures for commercial purposes, you may indeed post them! You may also wish to make certain that the picture you post are within the laws in your country for public decency (in the U.S. pornographic pictures are restricted).

I think you should consult a lawyer. DO NOT do a business without understanding the laws involved. People are quick to throw a lawsuit on you for a financial gain.
Best of luck :)

You may not post the pictures of private individuals for your commercial gain without their permission. The only exception is elected public officials.
