I was ina motor vehicle accident in Ky. I didn't have insurance on my vehicle which is a state law. The accident report states that no one is at fault, but everyone who reads it says it is his fault. the other driver had insurance, and now I'm wondering should I sue because my vehicle was totaled and my daughter substained back injuries and I have a stack of medical bills. If I do sue, can I even win?

His insurance should cover your medical bills. You're vehicle is at a loss.

The best advice I can give is to talk to a lawyer... some give free consultations.
I'm guessing you may be able to fight for payment on your daughters medical bills, since it was not her fault that she was sitting in a car with an uninsured driver. (Consider, if she was sitting on a bike and got hit by a car... that person's insurance would have to pay). As for your car, I doubt you can win anything because you are at fault there. You knew that insurance is required.

Some states have weird laws about the fault of an accident changing if one party has no insurance. You could file a civil suit, which is much more likely to get you money. With a civil suit, you generally only have to prove that it was him driving his car, you driving yours with your daughter, and that your car and she COULD have been damaged within a reasonable doubt from the accident.

If you have a kid, get insurance, there's no excuse. If you can't afford it, take the bus.

This is why you SHOULD have auto insurance. If you do sue, somebody MAY have to fork out the money for your injuries and the rest of us who do have auto insurance pay for it with higher premiums. Sorry, I hate when I have to pay for others being irresponsible.

Check with an attorney, that should cost nothing, and he should be able to tell you if you have a case.

You could be sued because you did not have insurance.
