Second dregree murder means they didn't kill on purpose. Meaning they didn't plan the murder in advance.

djpaul is absolutely INCORRECT. What he gave was the definition of First Degree Murder.
Second Degree Murder is when you make an on-the-spot decision to kill someone with NO PRIOR PLANNING OR PREPARATIONS. A classic example of this is the old "crime of passion" case where the husband comes home to find the mailman in bed with his wife, and then kills one or both of them. That would be 2nd Degree Murder; there was a killing, it was NOT planned, and it took place as the result of a spur-of-the-moment decision.
Murder in the Third Degree is also called Manslaughter. That's when you kill someone accidentally, like in a car accident or you get into a bar fight, hurt someone, and they later die.

In order for someone to be found guilty of second degree murder the government must prove that the person killed another person; the person killed the other person with malice aforethought; and the killing was premeditated
